Overview


Criminal cases from its inception are guided by the provisions of Criminal Procedure Code (Cr.P.C.), whereas Cr.P.C. has not prescribed any time limit for filing the charge sheet under any of its provisions.

Whereas, u/s 167 of Cr.P.C. an accused can seek for bail as a right known as default bail in case charge sheet is not filed within ninety-days, where the investigation relates to an offense punishable with death, imprisonment for life or imprisonment or imprisonment for a term of not less than ten years or Sixty days, where the investigation relates to any other offense.
